Marriage Rights: Voting For the Obvious





            Just this year, SCOTUS has had many a case brought before it that can be deemed controversial. Gay Marriage Rights was finally ruled upon in a case called Obergefell v. Hodges. This was tied to five other cases of similar style calling for the Court to decide if homosexuals had the right to marry in the eyes of the law. The Court ruled that marriage is a right for all consenting adults be they homosexual or heterosexual (576 U.S. ___). This has caused a backlash all over the country from people who think that such actions are illegal and in their opinions against "God's Laws".
            Obergefell v. Hodges was years in the making, it started with DeBoer v Snyder (576 U.S. ___). This was a Michigan case that was filled in  2012 due to the couple being black balled from sharing parenthood of their son because they weren't in a legally recognized marriage (772 F.3d 388). Deboer's case was focused on the state's adoption laws but was refocused towards the marriage law as that was the true thing holding the couple back (772 F.3d 388).  This worked and the couple went on to sue the state claiming that anti-gay marriage laws were against the United States Constitution(772 F.3d 388). This snow balled into 5 cases making the equivalent of a class action law suit against the Fed under the claim that anti gay marriage laws violated people's rights under the Constitution. Obergefell came a year after in 2013 when one half of a gay marriage died and the other half requested that he be placed on the death certificate as his husband and surviving spouse (576 U.S. ___).
            The five cases were combined under the title Obergefell v. Hodges (576 U.S. ___). The claim was that the laws in each state violated the claimants 14th Amendment rights to Due Process and Equal Protection (576 U.S. ___). The court agreed with the petitioners and ruled that the Fed and states must recognize and issue same sex marriage licenses or violate the inherent spirit of the 14th Amendment. SCOTUS has a heavy burden each year while they are in session to analyze each case presented carefully and weigh the cost of agreeing with the petitioner or tossing the case out for precedent (576 U.S. ___).
            Over the past couple of years cases have been brought before the Supreme Court that have systematically destroyed all legal argument for denying two consenting adults under the spirit and heart of the United States Constitution. Obergefell and the various petitioners have been given the same rights as those in heterosexual relationships (576 U.S. ___). The Constitution cannot be taken literally or else laws on marriage wouldn't be allowed in the first place as the lack of writing upon them would create a void in the government. The Constitution has to be taken in the spirit it was written instead.

            The 14th Amendment states: " Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." (Cornell University Law School). The spirit of the law in this passage is how cases such as "Brown v. Board of Education" those cases were looked at not in the letter of the 14th Amendment, but in the spirit of the Amendment it guarantees each child, regardless of ethnicity or gender, an education that is the same as everyone else. There is no logical reason that marriage rights shouldn't fall under the same thought process as education. Before this case was put before the Supreme Court, the law couldn't legally tell two heterosexual adults they couldn't get married because of the color of their skin, that was ruled unconstitutional years before, gender is no different. In this case I agree with the majority that to deny homosexual couples the same right that their heterosexual counter parts enjoy each day is turning our back on the keystone of social order that marriage is in our country. I also agree with the majority that the idea of same sex marriage harming the marriages of straight couples is ridiculous and that no lasting harm can happen to any current or future heterosexual marriage by allowing same sex couples to marry (576 U.S. ___).

            Marriage is a fundamental right promised in the Constitution by its promise of the right to freedom and happiness for every person in this nation. By denying gay couples because of a small group's ideal of moral propriety is to thumb our noses at the spirit that was engrained into the very parchment our founding fathers wrote it on. By denying a portion of our nation the same rights that a majority of the nation gets is turning our backs on the basis of our society that all men are equal.

I am...tired

I can't explain it any other way. I am tired. I can feel everything I believed in fading. I look around me and I see everyone else's lives going places while mine seems to be lingering and going to pot. 

It seems, the more I try to make myself a better person, the worse my life gets. People keep telling me it's that challenge God has put before me and the more I hear it, the less I believe it. If God really cared enough about little ol me I doubt my life would be this crappy for this long. Even people who's lives were worse then mine 6 months ago are now suddenly doing better then I.

I seems the world is against me any more. I can't seem to land a full-time job, my current part-time job is complete shit, and as usual I can't get medical coverage because I have too many health problems.

I don't have the support system everyone else does in law school. I don't have a husband working full-time while I go to school and don't work because he can pay the bills. I don't have parents to live with either. I have NO ONE to rely on. Oh sure, I have a fiancĂ©  but he can barely make it as well and I won't move in with him as his roommates are disgusting pigs. And there is no way we could afford to live together, even with me working now.

It seems like nothing I do makes it better. Everything I've done to make my life better seems to make it all worse. The only bright spot I seem to have is the man I love and even that seems to be fading. He says he loves me but lately it's all been come ons and whining about the no sex until marriage thing and how I'm not affectionate enough or how he isn't happy about waiting for a few years while we get through school and whining about how he'll be "old" by the time HE can have kids. I feel like any more it's about how HIS life is effected by my choices and how the choices of those around him benefit him the best. 

When I got the crap job I have now, the first thing he said was that HE would get a program back under my name. When his mum got a settlement, he was all too happy to leap on going out and celebrating with her. 

It feels like the more he complains, the less it matters that it's about respecting my choices and who I am as a human being and the more it matters that he gets physical gratification. 

The people around me aren't much better. I now have nearly everyone around me pressuring me to cave in and just sleep with him and stop being so "mean" to him. The same with living with him. It's "mean" of me to not want to sleep with or live with him until we are married. It's "mean" of me to stick to my beliefs because everyone around me doesn't believe what I do. 

It's like my beliefs no longer matter because he put a ring on my finger. Now that I am engaged to be married I seem to no longer have my own identity or choices. 

The pressure to conform to what everyone wants or thinks I should be doing with my fiancĂ©. And apparently that is violating every creed I live to and hold onto as a woman. 


School isn't much better anymore. It's like the longer I attend, the more glaring it becomes I don't and will never fit in with my class mates. I'm not rich enough, or married enough, or working full-time enough. Everyone else seems to always have time to do things with friends and family and it seems like I am alway studying and working and sleeping and getting no where. Everyone around me is doing great and it's like I'm just treading water. I don't even feel like I'm keeping my head above water any more.

I can't seem to make friends. I have tried. I have tried to reach out to people and it seems like no one wants me around. I have tried to join study groups and they kind of let me in and then just leave me out. I got my first grade back and it was good, but I don't know if it's even worth it to keep going if no one wants me around in classes or study groups either.


It feels like my life is going out of control and no one cares because nothing I do is right to them. I feel so tired and just ready to give up. Maybe it isn't worth it anymore. Maybe I'm just not worth it anymore.  Maybe it's just not worth trying to make things better. Maybe it's my fate to be a pathetic nobody like I was born. Maybe I'm not good enough to rise about being in the bottom of the poverty level, one step from being homeless. Maybe that's my fate for life and I'll never know what it's like to not worry about if I can make rent or eat or put gas in the car. Maybe I should just give up on it all.

My job interview is in less than 48 hours. I pray to God I get this job. He knows I need this to get my life on the proper track. I pray his will is in the path of mine and this job is my path in this next stage of my life.

No one truly understands

I live everyday in constant pain. Every inch of me hurts from sun up to sun down. People think they can understand but they don't. Sure they have aches and pains but those go away. Mine never does. I'm sick, I have an illness that can never be cured. Yes, it can be treated but the benefits of the meds don't out weigh their negatives. I'd rather live in pain everyday of my life then live in a drugged haze like most doctors would want me to.

But no one likes to hear that I'm ill. It's about their lives and their aches and pains. It's about their desire to pretend that there is nothing wrong with anyone else. No one likes to hear that someone they care about is sick, especially when they don't appear to be ill. Not all illnesses give off an outward symptom. I was born with Fibromyalgia. I will die with it as well. My nerves are fried and can never turn off. People don't want to have to acknowledge that a person who can smile, laugh, pull 32 hour work weeks, and go to school full time, could possible be ill and not receive treatment.

I tried getting treatment. I've had the disease for so long my body can't handle the meds. I was on them, I spent one year on them and most of the time was a zombie. Because of my illness my memory is shot, I have to write a lot of things down most people would be able to remember with one try.

This illness makes me depressed, it comes and it goes and for once I wish someone would truly understand.... but no one truly understands

Busy busy busy

I have been a very busy little bee. I am now back in school and working as well. School has made it a bit weird since I have class every day of the week. And I'm still pulling 6 hour shifts. Class is at 11 so I have a couple hours before it to get a bit of work but then after class I have to get my shift done and on Mondays and Tuesdays I have a night class that starts at 430 so fun for me >.<

Talk about your early mornings. I get up for work, then class, then back to work again before going home to eat dinner, study and get some knitting done for my new Etsy store. check it out.

Sad day...

So today is a sad day for me. Not for a personal reason, but because I realized how sad many people I consider to be my friends really are. A friend of mine got married to a guy after dating him for 5 months. They were only married for a couple of years before she moved back home and started divorce proceedings. To cap it off, she is already dating another guy, her divorce isn't final I might add, saying this one is the love of her life and how happy they are and how he is the greatest thing to ever happen to her... This saddens me because it's a glaring example of how people my age rush into marriage, and when things get bumpy, rather than fix things or work on them, they just throw it away and run back home to mummy and daddy. They go from claiming to have the perfect marriage to trying to smear campaign each other into humiliation and it greatly depresses me because they chose to leap into a marriage and yet don't have the maturity to fight for it when real life proves to be difficult to make it as adults with out the parents to pay for everything or give them money when ever they ask.

This particular girl has already moved back home, into her old room, gotten mummy and daddy to buy all new stuff for her to decorate with and has begun to "Flaunt" her new life for all to see. She acts as though it all never happened and that her life is once again perfect and untouched. She has gotten her parents to do more now for her then before she had been married and it's just a sad realization that marriage is dying because people have an overly romanticized view of what marriage is going to be like.

Marriage is hard work, no matter how strong you think your relationship is, once living together, paying bills and no longer having much in the way of private time exists, things become hard work. You have to work a lot to make things smooth and always be willing to discuss things and work them out.

They have a saying to never go to bed angry, but in reality, going to bed upset can help things come morning. Once both people have slept and have had a chance to calm down, it's easier to talk things out with out having ruffled and puffed out feathers to pick at.

Need to Vent

I know people generally use their blogs to rant and vent and I try to avoid this as much as possible. I use this blog mostly to talk about my life and the exploration there in.

That being said, I do occasionally feel the need to vent and rant and make my feelings known. As I live in an interesting world. Ranting to the people who have caused the issue would only make the issues worse. Especially when the rant and anger feelings are directed towards my boyfriend's roommates and their childish fear and paranoia. The boyfriend and I finally got a date for once where we didn't have his roomies tagging along or inviting themselves. This was blown to kingdom come while we were watching Prometheus in theater, an awesome movie by the by, when one of the roomies decided to call and whine at him because he forgot to lock a bolt in the door!

This angered me because they know perfectly well, if someone wanted to rob the house, a single bolt isn't going to stop them! These two LITTLE CHILDISH BOYS lock the house up like a freaking prison all day long. They get pissy if the door is unlocked for longer then it takes to walk into the house. They throw these freaked out temper tantrums when the BF or I cook and we open the door and sliding glass door to let things cool out naturally while we cook rather then raise the electric bill by using the AC. One of them even had the gall to lock the house up with the BF and I sitting in the rooms with said doors so we could watch them! He comes out every two hours! I swear! Just to unlock the front door, check the locks on the security door and re-lock the front door! He even takes the stick out of the sliding glass door to open and re-lock the sliding glass door!!!!!! The level of angry I have reached with this is impossible to describe!


Alright, venting done. Going to do something that makes me happy whilst I growl at the little boys my manly adult boyfriend is stuck with for roomies and sadly for friends.

Wow...

This semester at school has been crazy, between the mentoring program blowing up and me not getting enough hours to get a grade I think I should have gotten and the class that I thought would be the easiest turning out to be the hardest, I can't believe I survived.


These are my grades as of now and while I am proud, I wish my last class would drop...I know I passed, but I would feel ten times better if I knew what the grade was. I can't relax until I do.

My car was broken into and a bunch of my gaming stuff was stolen. My dice bag was gone and so was my atari belt buckle that I was suppose to take that day and get made into a nice belt. They also took my prescription sunglass which made me mad, but the dice bag being stolen made me cry for quite a bit.




My poor car. I ended up having to get the window replaced as well and that bugged me because you can only get UV treated glass from the dealership and they wanted way more then I was willing to pay for it. I know a glass place that was able to get me a regular window and it works fine. I called the eye glasses place where I get my eye exam every other year and they were nice enough to give me a new pair for the same price I got my old pair. They aren't nearly as nice, but they will work until next year when I am due for a check up and replacement of my lenses anyway.

When I realized my dice bag was gone I had to go out and buy new dice. I've spent a lot of cash on dice in the last few weeks and it doesn't even match what I  had yet. I also wound up knitting my new dice bag, but I won't be posting that photo here. Those photos will be going on my blog that is about my knitting as this one is about my life and things I feel shouldn't be linked to my Facebook account.

I'm getting ready for the LSATs this october and it's kinda got me scared. I want to score well and I need to. The law school I want to go to has told me that the higher my LSAT score is, the less they will look at my GPA. However, I am confident I can get a decent enough score.

It gets better.

This is a post for all the teens out there.

You've been called names, teased, made fun of. You've been made to feel that you are some how less because you aren't exactly like everyone else. You've been made to feel like you are less because you don't wear what is in style or you don't believe in showing cleavage or all of your legs. You've been made fun of for not being skinny, for being too skinny, for wearing glasses, for not having straight teeth or straight hair. You get teased for liking video games, or liking books too much, for being too smart and willing to participate.

You've been teased for being gay or appearing to be so. You've been teased for begin poorer then others or for not being someone that everyone else claims to be


Instead of hiding who you are, be proud of it! You are perfect as you are! I am a chubby chick with messed up teeth and brain. I have an addiction to books, horror flicks, magic the gathering, D&D, L5R, and anything else that could be considered nerdy and I am proud!




I knit, game, and watch tons of movies while I study. While in class, I speak my mind, take lots of notes, and will prove anyone wrong if I KNOW I am right! 

Hold your head high! Don't be ashamed of who you are! If you are different, EMBRACE IT!!!

It does get better, even if you never have tons of friends and don't always get the hot fun dates, being who you are and having a few close friends is more important then sacrificing your happiness.

School...

School has been well. Going to class everyday, only missed one class. I've had two or three cancelled so far. I will be mentoring a young girl for the rest of the semester starting on Tuesday. For my evidence class we are talking about notices and witnesses, which blends in well with my Crim Pro class since we are on eyewitness and line ups. My jury class is talking about witnesses and testimony as well, but my juvenile justice class isn't really talking about much. We don't even start talking about the significant criminal cases for kids until next week for pete's sake! >.<

Other then that, my life has been ok. School has been well, life has been well. The bf took me on a super awesome date. We went to a really high end restaurant and it was all his treat! I loved it! So can't wait for my b-day!!!!

Rambles.....

I don't know why but for some reason I feel like rambling. Maybe it's because I've had a head ache for a few days, or because I over did it on food today, or because I'm really tired and should crawl into bed, but don't want to. But I do know that I've had a though going through my head for a few days now, everyone gets asked at least once in their life if they could go back and change anything, would they? Well for me at this point, my answer is: No, I wouldn't change a thing. Every ounce of pain, every tear I have shed, every drop of sweat that has fallen from my brow has helped make me who I am today. It has helped shape my life, my heart, my mind, and my soul. I would never have learned how to stand for myself, voice what I want and take what I want when I have earned it. With out that pain and suffering, I never would have learned how to savor the sweet things in life and with out those sweet things I wouldn't have anything to look forward to or remember when painful, scary, or stressful situations arise.

I've also come to the rather scary conclusion that I do truly love my boyfriend and that I do want to marry him... The reason this scares me is simple really, I don't want to fall for someone so hard and that deeply that I can become seriously hurt. What got me to come to this conclusion you ask? Well, I had a visit with my visiting teacher and she asked if the BF and I had talked of marriage. Truth be told, yes, have. It's normal in a young couple is discuss such things and it shows that we are both looking to be adult about our lives and not just "Go with the flow". I do actually want to get married again, despite the emotional pain that my first marriage was and the nightmare it became towards the end. Part of what holds me back is the fear of becoming a burden on someone again. I don't want someone else to have to take care of me after I just discovered my ability to stand on my own two feet.

Rant done for now. I may come back to this post again and add more as the time is needed.

New years

So my New Years was interesting. We'll leave it at the BF and I had a long talk about things in our relationship and I feel things to be stronger then ever even if I feel insecure anyway. Trust may always be an issue with me because of how my last couple of relationships ended. Both exes chose to place the blame on my shoulders despite one of them chose to cheat and the other chose to listen to a bunch of lying back stabbing insert the word for despicable females. Yes, I am still mad about both break ups, but that's because both of them crushed me in ways that never should have happened. But on a better note, I've gotten a few knitting things done. I am nearly done with my first sweater and I have gotten a couple of minor projects out of the way such as a very pretty necklace. I am thinking of starting another knitting project, a small one as a distraction from the long duster length jacket I am currently working on. It's already to my knees and I can't wait to get to wear it. Though I will never wear it to school when I need to wear a backpack. I still have a couple of weeks to go before school starts and I want to get in as much relaxation as I can. I have been gaming as much as I can as well as knitting. But sadly this stupid thing called work keeps getting in the way lol. It is also part of the whole having a BF thing that keeps me from getting all the knitting I want to get done done lol. Christmas holidays....

Christmas was a blast! I got awesome things! I got this beautiful watch and sweater from the BFs mom, a wonderful skein of yarn from his sister and bro in law, a great dvd from the BF, and a book from his mum again! It was great! I may have only gotten a few gifts but I loved them all and the thought that was put into them. I did the same, only I got everyone a single gift. Except the BF and his nephews. I got the boys a gift to share and the BF's present had little goodies in it. In his body pillow, there was chocolate and a dvd for him to watch lol. Over all Christmas was great! Hope all my readers had a great one as well.

Just a note, I would really love to hear from the people who have read my blog thus far. It would really mean a lot to me if someone were to tell me what they thought of my words as they come out.

The weekend

Things were...interesting this weekend. I offered to watch the BF's nephews, believing it was going to be only for the after noon, imagine my surprise when I find out his sis and her husband were going to be gone all night and I would have the kiddos that long >.< Now, don't take this wrong, if she had asked, I would have said yes, but it did tick me off that she assumed I would be willing. I did wind up watching the kiddos all night and thankfully the BF came over to his mum's after work. Like a respectful man, he slept on the couch, holding guard, while I slept in the spare room and the kiddos slept in their grandma's bed. I did enjoy it and I was glad the BF called his sis and made it clear she has to ask from now on if I'll watch the kiddos over night and not just assume I will.

I am looking forward to X-mas this year. This will be the first year where I think I'll actually feel welcome in a house since before my grandma died. The last few years, each Christmas, no matter where I go or who I am with, even if it's my own family, I've felt like an outsider. I hope to eventually have a holiday where I don't feel like I'm just along for the ride.

Le Sigh

Today has been a Le Sigh day. Woke up with a headache so I stayed in bed for a bit. Next time I regained consciousness it was nearly noon and I had work today. So I did the "Oh crap!" Scramble and headed off for work which as usual when I wake up late or am not feeling well, is a disaster. Got done with work in time to head to the yarn shop and knit a bit. That relaxed me for a while. Then I stopped for food at Denny's and spent time with the ladies there since I am a bit of a regular. It's crazy to think that I am a regular at a Denny's lol, but sadly I am, even if I just stop in for a soda they know me. Once I was done there I headed home and commenced to do my paper work for my job and got onto Facebook where a "Friend" decided that she knew more about my job then I did. Hopefully once she's up at her university I won't have to deal with her pathetic know-it-all shit anymore. It's weird to see how different her and my life have gone in less then a year. As my life has progressed in a more positive way, hers only seems to be getting worse and she seems determined to drag everyone else down with her. She got super pissed that I found someone and have fallen in love and the only prospects she has are her dead beat ex-bfs >.< Just because I have actually tried to make my life better and she hasn't she thinks she has to keep me where I am in life.

I have worked hard to get where I am and I won't let anyone pull me down from it!

School

Got two of my grades back both Bs, now I only have 2 grades left to get. Only one of them is one I need to worry about. I still have two papers to write as well. Thankfully they should be easy ones too. What I'm worried about is the one class since I've struggled so hard in this class. The quizzes were easy but the prof asks such vague and weird questions on the exam it's hard for me to wrap my head around them and give him the answer he wants. It drives me nuts he does that because some of them I can answer in just a few sentences and still cover all he needs, but he docks points because they aren't the length he wants and I've made it very clear I don't like to fill with fluff when I write academic papers.

Presentation

So I gave my presentation today... I hated every second of. Even though the paper was a hit. I was extremely disturbed by my research and so was most of my class. There is something soul killing about researching Child Trafficking around the world. Something very soul stealing indeed. I have found myself more then once wanting to curl up and cry from what I've read, and the photos I've seen. There are things that I have seen in just a short amount of time that I cannot un-see no matter how much I wish I could. I knew child trafficking was bad, but I never realized just how horrific it really was. It isn't just about sex. Given a few of the news articles that I read, children are being mutilated for religious reasons as well and I think that was only second in horrifying to finding out that little innocent baby girls are being brutalized because of a myth that the rape of a virgin can cure AIDs!

To my readers, please please help to fight this horrific tragedy! These innocent little children deserve a chance at a happy childhood!

Sadly this work has affected my sleep. When I close my eyes I see those sad little faces and it makes me want to cry even more. I have 3 finals on Thursday and I need the sleep and yet I can't seem to get it. This is going to be a long couple of days...

Nothing like Recovery...

Nothing like having to recover from an upper respiratory infection while doing presentations for school, studying for 4 finals that are all happening on the same day, trying to hold down my job, and writing 3 papers at once... My life is nuts and yet I am happy about it.

I can't say why, but it seems the more pressure that I have to get things done, the happier I feel in my life. I guess it makes me feel like I matter for some reason... Must consider this....

Sick...more than sick in love

So having a BF with a lot of friends and family has proven dangerous to my health. In one weekend I was exposed to at least one virus and at most 3 and I was unfortunate to catch one >.< I now have the Upper Respiratory Infection from hell caused by a virus. Hello coughing fits the week before finals.....
